This is the first post in a series which will deal with the issue of defending against drug charges in Long Island, New York. I am writing on this issue due to the fact that, for obvious reasons, many people do not know how to proceed after they or a loved one have been arrested. I am addressing these issues for a number of reasons. First, and unfortunately, it is not uncommon for law enforcement to violate an individual’s Fourth Amendment rights. If such a violation leads to incriminating evidence, then it may be possible to exclude the evidence from Court proceedings. Second, police sometimes use informants as part of their investigation. If the information from these informants is unreliable, then it may be possible to gain a dismissal of the charges. Third, many individuals make the mistake of thinking that illegally possessing prescription pills is “no big deal.” The fact of the matter, however, is that such possession can have serious consequences. Finally, it is important to understand the serious nature with which law enforcement and Judges take matters which involve “hard drugs.”
